Welcome to Fortfolio.io ("Fortfolio," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (fortfolio.io), services, including our proprietary premium options screener, investment strategies, educational resources, alerts, and private community (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Acceptance of Terms

Your use of the Services constitutes your agreement to these Terms, our Privacy Policy (linked at fortfolio.io/legal/privacy), and any additional rules or guidelines posted on the site. We may update these Terms at any time; continued use after changes signifies acceptance. You are responsible for reviewing updates periodically.

2. Eligibility

You must be at least 18 years old and legally capable of forming a binding contract to use the Services. By using the Services, you represent that you meet these requirements. We reserve the right to refuse or terminate access for any reason.

Fortfolio provides informational tools, including a real-time options screener for identifying potential trades (e.g., cash-secured puts and covered calls), educational resources on income-focused strategies, screener alerts, and a private Discord community for user discussions. These are for educational and informational purposes only. We do not execute trades, manage accounts, or provide brokerage services.

4. User Accounts and Subscriptions

To access premium features, you may need to create an account and subscribe. You agree to provide accurate information and maintain the security of your credentials. Subscriptions are billed as described on the site; all payments are non-refundable unless stated otherwise. We may modify pricing with notice.

5. User Conduct and Responsibilities

You agree not to: (a) use the Services for illegal purposes; (b) interfere with the site's operation; (c) post harmful, misleading, or infringing content; (d) reverse-engineer our tools; or (e) share access credentials. You are solely responsible for your use of the Services, including any trades based on our information. Conduct your own research and consult professionals.

All content on Fortfolio.io, including the screener, strategies, text, graphics, and software, is owned by us or our licensors and protected by copyright, trademark, and other IP laws. You are granted a limited, non-exclusive license for personal use only. No reproduction, modification, or commercial use without written permission.

7. Third-Party Data and Links

We source data from third parties (e.g., APIs for earnings reports or market data), which may be delayed, inaccurate, or incomplete. We are not liable for such data. Links to external sites are for convenience; we do not endorse them and disclaim responsibility for their content.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE RESULTS, PROFITABILITY, OR PROTECTION FROM LOSSES. TRADING OPTIONS INVOLVES SUBSTANTIAL RISKS, INCLUDING TOTAL CAPITAL LOSS. PAST PERFORMANCE DOES NOT INDICATE FUTURE RESULTS. FORTFOLIO IS NOT A REGISTERED INVESTMENT ADVISOR, BROKER-DEALER, OR FINANCIAL INSTITUTION AND DOES NOT PROVIDE PERSONALIZED FINANCIAL ADVICE. ALL CONTENT IS INFORMATIONAL ONLY; CONSULT A LICENSED PROFESSIONAL BEFORE ACTING.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTFOLIO, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS, SO THESE MAY NOT APPLY.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fortfolio and its affiliates from any claims, losses, liabilities, or expenses (including attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Termination

We may suspend or terminate your access at any time for any reason, without notice. Upon termination, your license ends, and you must cease using the Services. Sections surviving termination include Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively through binding arbitration in Delaware under the American Arbitration Association rules, waiving class actions. You consent to personal jurisdiction in Delaware courts for injunctive relief.

13. Miscellaneous

These Terms constitute the entire agreement. If any provision is invalid, the remainder remains enforceable. No waiver of any term is effective unless in writing. We may assign these Terms; you may not without consent.
